I. Introduction and Scope
This Privacy Policy describes how LiveRecover, LLC ("LiveRecover," "we," "us," or "our") collects, uses, discloses, and protects information when you use our websites, mobile applications, SMS text messaging platform (the "SMS Platform"), Shopify application, and any other products or services we offer (collectively, the "Services").
LiveRecover provides an SMS-based cart recovery service for e-commerce merchants. Our trained human agents send personalized text messages to consumers on behalf of our merchant customers to help recover abandoned shopping carts and improve sales conversions.
In providing our Services, we act in two capacities: (1) as a "data controller" (or "business") with respect to information we collect directly from our merchant customers (such as account registration and billing data); and (2) as a "data processor" (or "service provider") with respect to consumer personal information that we process on behalf of our merchant customers through the SMS Platform and Shopify integration.
By using our Services, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy. You must also comply with our Terms of Use and any other posted policies.
II. Information We Collect
We collect and receive information in several ways depending on how you interact with our Services.
A. Information from Merchants (Our Customers)
When you register for or use our Services as a merchant, we may collect: account registration information (such as your name, email address, company name, and phone number); billing and payment information (such as credit card number, expiration date, and billing address); Shopify store information and credentials; business information related to your use of our Services; and communications you send to us (such as support requests and feedback).
B. Information from Consumers (End Users)
When consumers interact with our SMS Platform, we may collect or receive: phone numbers; names and contact information; shopping cart contents and product preferences; purchase history and order information; SMS message content (messages sent to and received from consumers); and opt-in and opt-out preferences.
Most consumer information is received through our integration with merchant Shopify stores. Consumers do not create accounts directly with LiveRecover. Information is provided to us by merchants or collected through SMS interactions initiated on behalf of merchants.
C. Information from Shopify Integration
When merchants connect their Shopify stores to LiveRecover, we access data through the Shopify API, including: customer profiles (names, email addresses, phone numbers); checkout and cart data (abandoned cart contents, product details, pricing); order history and transaction records; and store configuration and settings relevant to our Services.
This data is accessed and processed solely to provide our cart recovery services on behalf of the merchant.
D. Automatically Collected Information
When you visit our websites or use our Services, we may automatically collect: IP addresses and domain names; browser type, version, and operating system; device information and identifiers; pages visited, time spent on pages, and navigation paths; referring and exit URLs; date and time of access; and other usage data and analytics information ("Usage Data"). Usage Data may sometimes be essentially anonymous when collected but could be used indirectly to identify a person.
E. Cookies and Tracking Technologies
We use cookies, web beacons, pixels, and similar tracking technologies to enhance your experience and collect information about how our Services are used. Specifically, our website uses the following technologies:
(1) Google Tag Manager (GTM) for managing analytics and marketing tags; (2) Attribution.js for tracking marketing attribution and UTM parameters across visits; (3) Warmly for visitor identification and engagement; (4) Unify Intent for website visitor insights; and (5) a cookie consent manager to obtain and manage your cookie preferences.
Most web browsers automatically accept cookies, but you can usually modify your browser settings to decline cookies. However, disabling cookies may affect the functionality of our Services. When you first visit our website, you will be presented with a cookie consent banner that allows you to accept or manage cookies.
III. How We Use Your Information
We use the information we collect for the following purposes:
(1) To provide, operate, and improve our Services, including sending SMS messages to consumers on behalf of merchants through our trained human agents; (2) to manage merchant accounts, process payments, and fulfill service obligations; (3) to personalize and optimize our cart recovery strategies and messaging; (4) to communicate with merchants about their accounts, provide customer support, and respond to inquiries; (5) to analyze usage trends, monitor Service performance, and compile analytics and reports; (6) to improve our service quality, train our agents, and develop new features; (7) to detect, prevent, and address fraud, security issues, and technical problems; (8) to comply with legal obligations and enforce our Terms of Use; and (9) to compile anonymized and aggregated data for research, analysis, and service improvement.
We reserve the right to make full use of Usage Data. For example, we may use Usage Data to provide better service, customize the Services based on preferences, compile and analyze statistics and trends, and otherwise administer and improve our Services.
IV. SMS Communications and TCPA Compliance
LiveRecover sends SMS messages to consumers solely on behalf of our merchant customers. All messages are composed and sent by our trained human agents.
Consent. SMS messages are sent only to consumers who have provided prior express written consent through the merchant's checkout process or other opt-in mechanism. LiveRecover does not independently collect SMS consent from consumers; consent is obtained by and through our merchant customers.
Message Frequency. Consumers typically receive between one and three SMS messages per abandoned cart event. Message frequency varies based on merchant settings and consumer engagement.
Opt-Out. Consumers may opt out of SMS messages at any time by replying STOP to any message. Opt-out requests are processed immediately. After opting out, you will receive one final confirmation message and no further messages will be sent. We honor all opt-out requests within the timeframes required by applicable law.
Help. Consumers may reply HELP to any message for assistance or contact us at support@liverecover.com.
Quiet Hours. We do not send SMS messages between 9:00 PM and 8:00 AM in the recipient's local time zone.
Message and Data Rates. Standard message and data rates from your wireless carrier may apply to SMS messages you receive.
V. Sharing and Disclosure of Information
We do not sell your personal information to third parties. We do not share your personal information for cross-context behavioral advertising purposes. We may share your information in the following circumstances:
With Merchants. Consumer information collected through the SMS Platform is shared with the merchant on whose behalf we are operating. Merchants may use this information in accordance with their own privacy policies.
Service Providers. We share information with trusted third-party service providers who assist us in operating our Services, including hosting and infrastructure providers, payment processors, SMS carriers and messaging providers, and analytics services. These service providers are given access to information only as reasonably necessary to provide the services for which they are contracted.
Shopify. Information flows between LiveRecover and Shopify as necessary to provide our cart recovery services. This data exchange is governed by the Shopify API terms and our merchant agreements.
Legal Requirements. We may disclose your information if we have a good-faith belief that access, use, preservation, or disclosure is reasonably necessary to: (i) satisfy any applicable law, regulation, legal process, or enforceable governmental request (such as a subpoena or court order); (ii) detect, prevent, and address fraud or other illegal activity; or (iii) investigate, respond to, or enforce violations of our rights or the security of our Services.
Business Transfers. In the event of a merger, acquisition, reorganization, or sale of assets, your information may be transferred to the acquiring entity. If such a transfer results in a material change in the use of your information, we will provide notice as described in this Privacy Policy.
Aggregated and Anonymized Data. We may share aggregated or de-identified information that cannot reasonably be used to identify you. For example, we may share aggregate statistics about the general use of our Services.
Affiliated Entities. We may share your information with our subsidiaries and affiliated entities for purposes consistent with this Privacy Policy.
VI. Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. Our general retention practices are as follows:
SMS Conversation Data. We retain SMS conversation data for service improvement, quality assurance, and agent training purposes. Personally identifiable information within conversation records (such as names, phone numbers, and specific order details) is anonymized or removed after thirty-six (36) months. Anonymized and aggregated conversation data may be retained indefinitely for analytics, training, and service improvement.
Consumer Profile Data. Consumer profile information received from merchants is retained while the merchant's account remains active. After a merchant account is closed, consumer data associated with that account is deleted or anonymized within twelve (12) months, unless retention is required by law.
Merchant Account Data. We retain merchant account and billing information for the duration of the merchant relationship. After account closure, billing and transaction records are retained for seven (7) years to comply with tax and legal requirements.
Shopify Webhook Compliance. When we receive data deletion requests through Shopify's mandatory compliance webhooks (CUSTOMERS_REDACT, SHOP_REDACT), we process the deletion in accordance with Shopify's requirements and applicable law.
Website Analytics. Website usage and analytics data retention is governed by the applicable third-party provider's retention policies.
VII. Your Rights — California Residents (CCPA/CPRA)
If you are a California resident, you have certain rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, "CCPA"). This section applies to personal information we collect in our capacity as a "business" under the CCPA (primarily our merchant customers' information). When we process consumer personal information on behalf of our merchant customers, we act as a "service provider" and consumers should direct CCPA requests to the applicable merchant.
Your Rights. Subject to certain limitations and exceptions, California residents have the right to: (1) know what personal information we collect, use, disclose, and sell or share; (2) request deletion of personal information; (3) correct inaccurate personal information; (4) opt out of the sale or sharing of personal information (note: we do not sell or share personal information for cross-context behavioral advertising); (5) limit the use of sensitive personal information to purposes necessary to provide the Services; and (6) not be discriminated against for exercising your privacy rights.
How to Exercise Your Rights. To submit a request, please contact us at support@liverecover.com with "California Privacy Rights" in the subject line. We will verify your identity before processing your request. You may designate an authorized agent to make a request on your behalf by providing written authorization.
Response Timeline. We will acknowledge receipt of your request within ten (10) business days and respond to verifiable requests within forty-five (45) calendar days. If we need additional time, we will notify you of the extension and the reason for it. We may extend the response period by an additional forty-five (45) days when reasonably necessary.
Categories of Personal Information. In the preceding twelve (12) months, we have collected the following categories of personal information: identifiers (name, email, phone number, IP address); commercial information (transaction history, purchase records); internet or electronic network activity (browsing history, search history, interaction with our Services); geolocation data (approximate location derived from IP address); and professional or employment-related information (business name, merchant account details). These categories are collected for the business purposes described in Section III of this Privacy Policy.
VIII. Your Rights — Other US State Privacy Laws
Residents of states with comprehensive privacy laws — including Virginia, Colorado, Connecticut, Oregon, Texas, Montana, and others — may have similar rights to those described in Section VII, including the right to access, correct, delete, and port their personal information, and to opt out of certain data processing activities. To exercise these rights, please contact us at support@liverecover.com. We will process your request in accordance with the applicable state law.
IX. Your Rights — International Users
LiveRecover primarily serves merchants and consumers in the United States. All data is processed and stored in the United States. If you are located outside the United States, including in the European Economic Area (EEA), United Kingdom, or other jurisdictions with data protection laws, please be aware that your information will be transferred to and processed in the United States, which may not provide the same level of data protection as your home jurisdiction. By using our Services, you consent to such transfer. If applicable law requires a specific legal mechanism for international data transfers (such as Standard Contractual Clauses), we will provide appropriate safeguards upon request.

X. Data Security
We implement commercially reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, and destruction. These measures include encryption of data in transit and at rest, access controls and authentication mechanisms, regular security assessments, and incident response procedures. However, no method of transmission over the Internet or electronic storage is completely secure. We cannot guarantee the absolute security of your information.
XI. Shopify App Data Practices
LiveRecover is a Shopify application. When merchants install our app, we access certain store data through the Shopify API to provide our cart recovery services. This includes customer contact information, checkout and cart data, and order information.
We comply with Shopify's mandatory data protection requirements, including responding to the following compliance webhooks: CUSTOMERS_DATA_REQUEST — we provide the requested customer data to the merchant; CUSTOMERS_REDACT — we delete the specified customer's personal data from our systems; SHOP_REDACT — we delete all data associated with the merchant's store from our systems upon app uninstallation and the expiration of the required retention period.
Data accessed from Shopify is used solely for the purpose of providing our Services and is not used for any unrelated purpose.
XII. Children's Privacy
Our Services are not directed at individuals under the age of sixteen (16). We do not knowingly collect personal information from children under 16. If we become aware that we have inadvertently collected personal information from a child under 16, we will take steps to delete such information promptly. If you believe a child under 16 has provided us with personal information, please contact us at support@liverecover.com.
XIII. Links to Third-Party Services
Our websites and Services may contain links to third-party websites, applications, and services. Once you leave our site through such links, we have no control over those third-party services. We are not responsible for the privacy practices of any third-party services, and they are not governed by this Privacy Policy. We encourage you to review the privacy policies of any third-party services you visit.
XIV. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will notify you by updating the "Last Updated" date at the top of this page and, where required by law, by providing additional notice (such as email notification or a prominent notice on our website). Your continued use of our Services after any changes to this Privacy Policy constitutes your acceptance of such changes. We encourage you to review this Privacy Policy periodically.
